Applicability of AADHAAR to NRI/PIOs

As per Section 3(1) of the Aadhaar Act, 2016, every resident is entitled to obtain an Aadhaar number by submitting demographic and biometric information through the prescribed enrolment process.

Further, Section 2(v) of the Aadhaar Act, 2016 defines a "Resident" as an individual who has resided in India for a period of 182 days or more during the 12 months immediately preceding the date of application for Aadhaar enrolment.

The Prevention of Money Laundering Act, 2017 and Section 139AA of the Income Tax Act, 1961 stipulate that linking of Bank Accounts and PAN is applicable only to those persons who are eligible to enroll for Aadhaar under the Aadhaar Act, 2016.
